Welcome to DayZer0.

These Terms and Conditions ("Terms") govern your access to and use of the DayZer0 mobile application and related services ("DayZer0", the "App", "Service", "we", "us", or "our").

By downloading, accessing, creating an account for, or using DayZer0, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, you should not use the Service.

1. About DayZer0

DayZer0 is a health, fitness, nutrition, and wellness application designed to help users track information, understand their progress, and receive personalized recommendations.

DayZer0 may provide features including:

• Fitness and transformation goal setting
• Nutrition and meal tracking
• Calorie and protein tracking
• Workout and activity tracking
• Progress tracking
• Personalized recommendations
• Notifications and reminders
• Image-based food or progress tracking
• Artificial intelligence-powered features, where available

Features may vary between versions of the App and may be added, modified, or removed over time.

2. Eligibility

You must meet the minimum legal age required to use the Service in your country or have the involvement and permission of a parent or legal guardian where required by applicable law.

By using DayZer0, you represent that you are legally capable of agreeing to these Terms.

DayZer0 is not intended to be used by children where such use is prohibited by applicable law.

3. Your Account

Some features of DayZer0 require you to create an account.

You agree to:

• Provide information that is accurate and reasonably current.
• Keep your account information up to date.
• Protect your account credentials.
• Not share your account with another person.
• Notify us if you believe your account has been accessed without authorization.

You are responsible for activity occurring through your account to the extent permitted by applicable law.

We may suspend or terminate an account if we reasonably believe that the account is being used in violation of these Terms, applicable law, or to abuse or compromise the Service.

4. Health and Fitness Disclaimer

DayZer0 is not a medical service and does not provide medical advice, diagnosis, treatment, or emergency services.

Information, recommendations, calculations, targets, insights, meal suggestions, workout suggestions, and other content provided through DayZer0 are intended for general informational and wellness purposes.

DayZer0 should not be used as a substitute for:

• Professional medical advice
• Diagnosis from a qualified healthcare professional
• Treatment prescribed by a healthcare professional
• Emergency medical services
• Individualized advice from a qualified nutrition, fitness, or healthcare professional

You should consult an appropriately qualified professional before beginning or significantly changing a diet, exercise program, weight-management program, or other health-related activity, particularly if you have a medical condition, injury, are taking medication, are pregnant or breastfeeding, or have other circumstances that may affect your health or safety.

If you experience a medical emergency, contact your local emergency services or an appropriate healthcare professional. Do not rely on DayZer0 for emergency assistance.

5. Accuracy of Information

You are responsible for providing accurate information when using DayZer0.

Nutrition estimates, calorie calculations, protein estimates, exercise information, progress measurements, and other information displayed by the App may be estimates and may not always be accurate.

Food recognition and image-based analysis may incorrectly identify foods, ingredients, portions, or nutritional information.

You should use reasonable judgment and verify important health or nutrition information when necessary.

We do not guarantee that any target, recommendation, estimate, calculation, or other information provided by DayZer0 will be accurate, complete, or appropriate for your individual circumstances.

6. Artificial Intelligence Features

DayZer0 may include artificial intelligence ("AI") features.

AI-generated content may include:

• Nutrition estimates
• Meal analysis
• Food identification
• Fitness recommendations
• Personalized suggestions
• Coaching responses
• Summaries and insights
• Other automatically generated content

AI-generated information may contain errors, omissions, incorrect assumptions, or inappropriate recommendations.

You are responsible for evaluating AI-generated information before relying on it.

You should not rely on AI-generated information as medical advice or as a substitute for professional judgment.

We do not guarantee that AI-generated responses will always be accurate, complete, appropriate, or suitable for your individual circumstances.

AI features may be changed, temporarily unavailable, or discontinued at any time.

7. User-Provided Content

You may provide information, photographs, descriptions, messages, or other content through DayZer0 ("User Content").

You retain ownership of User Content to the extent that you have rights in that content.

By submitting User Content, you grant DayZer0 the limited rights necessary to store, process, transmit, display, analyze, and otherwise use that content to provide and operate the features you requested.

For example, if you submit a photograph for meal analysis, we may process that photograph to provide the meal-analysis feature.

We will handle personal information in accordance with our Privacy Policy.

You represent that you have the necessary rights to submit User Content and that your User Content does not knowingly violate applicable laws or the rights of others.

8. Acceptable Use

You agree not to:

• Use DayZer0 for unlawful purposes.
• Attempt to gain unauthorized access to the Service or another user's account.
• Interfere with or disrupt the operation or security of the Service.
• Introduce malicious code, malware, or other harmful material.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App except where such activity is expressly permitted by applicable law.
• Circumvent security, access controls, usage limits, or other restrictions.
• Abuse automated systems or APIs associated with the Service.
• Upload content that is unlawful, fraudulent, threatening, abusive, defamatory, or infringes another person's rights.
• Use the Service to develop or operate a competing service through unauthorized extraction or systematic collection of our content or data.
• Attempt to use DayZer0 to provide emergency medical services or professional medical advice.

We reserve the right to take reasonable action against activity that violates these Terms or threatens the security or integrity of the Service.

9. Intellectual Property

DayZer0 and its associated content, software, designs, branding, logos, interfaces, text, graphics, features, and functionality are owned by or licensed to us and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms or applicable law, you may not:

• Copy or reproduce the App or its content.
• Modify or create derivative works from the App.
• Distribute or commercially exploit the App or its content.
• Remove copyright, trademark, or other proprietary notices.
• Use the DayZer0 name, branding, or logos without our prior written permission.

These Terms do not transfer ownership of DayZer0 or its intellectual property to you.

10. Third-Party Services

DayZer0 may rely on third-party services to provide certain functionality, including authentication, cloud infrastructure, storage, notifications, analytics, artificial intelligence, or other technical services.

Third-party services may be subject to their own terms and privacy policies.

We are not responsible for the independent operation, availability, or policies of third-party services that are outside our reasonable control.

11. Availability and Changes to the Service

We aim to keep DayZer0 available and reliable, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

We may:

• Add or remove features.
• Modify existing functionality.
• Perform maintenance.
• Temporarily suspend functionality.
• Change technical requirements.
• Discontinue particular features or services.

We may make changes without prior notice when reasonably necessary for security, maintenance, legal compliance, or operational reasons.

12. Beta and Experimental Features

Some DayZer0 features may be released as beta, experimental, preview, or testing features.

Such features may:

• Produce unexpected results.
• Be removed without notice.

You understand that experimental features may not have the same reliability as fully released functionality.

13. Account Deletion

You may request deletion of your DayZer0 account and associated personal information.

Account deletion may be initiated through the mechanisms provided within the App or through our external data deletion page:

Deletion may permanently remove information associated with your account, including profile information, meal records, fitness records, progress information, and other associated data, subject to information we are legally required or otherwise permitted to retain.

Account deletion may not be reversible.

14. Suspension and Termination

You may stop using DayZer0 at any time.

We may suspend or terminate access to the Service if we reasonably believe that:

• You have violated these Terms.
• You have used the Service unlawfully.
• Your use presents a security or operational risk.
• Your activity may harm other users or the Service.
• We are required to do so by law.

Where reasonably practical and appropriate, we may provide notice before terminating access.

Termination of access does not affect provisions of these Terms that are intended to survive termination, including intellectual property rights, disclaimers, limitations of liability, and dispute-related provisions.

15. Disclaimers

To the fullest extent permitted by applicable law, DayZer0 is provided on an "as is" and "as available" basis.

We do not warrant that:

• The Service will always be available.
• The Service will be uninterrupted or error-free.
• Information provided by the Service will always be accurate or complete.
• AI-generated information will always be accurate or appropriate.
• Nutrition or fitness estimates will accurately reflect your actual circumstances.
• The Service will achieve a particular fitness, health, nutrition, weight, or transformation result.

Your use of the Service is at your own discretion and risk.

Nothing in these Terms excludes or limits any rights or protections that cannot legally be excluded or limited under applicable law.

16. Limitation of Liability

To the fullest extent permitted by applicable law, DayZer0 and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Service.

This may include loss of data, loss of profits, loss of business, or other indirect losses.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

17. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, damages, and reasonable expenses arising from:

• Your violation of these Terms.
• Your unlawful use of the Service.
• Your User Content.
• Your violation of another person's rights.
• Your misuse of the Service.

This provision does not apply to the extent that the relevant claim or loss results from our own unlawful conduct or liability that cannot legally be excluded.

18. Privacy

Your use of DayZer0 is also governed by our Privacy Policy.

Our Privacy Policy explains how we collect, use, store, process, and protect information associated with your use of the Service.

19. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the "Last updated" date at the beginning of these Terms.

For material changes, we may provide additional notice through the App or another reasonable method where appropriate.

Your continued use of DayZer0 after the updated Terms become effective means that you accept the revised Terms, to the extent permitted by applicable law.

If you do not agree with updated Terms, you should stop using the Service.

20. Governing Law

These Terms will be governed by and interpreted in accordance with the laws applicable to the operation of DayZer0, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in this section limits any mandatory consumer protection rights that apply to you under the laws of your jurisdiction.

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.

The remaining provisions will continue to apply.

22. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented to you for specific features, constitute the agreement between you and DayZer0 regarding your use of the Service, except where applicable law requires otherwise.
